1. Introduction
Welcome to Jose Art Gallery that is a professional network of artists, collectors, art galleries and curators as well as online gallery of Visual Arts (hereinafter - «Jose Art Gallery», «Service Provider», «We» or «Us»).
These Terms of Use (hereinafter - «Agreement», «Terms») contain points according to which it is possible to use our services, in particular: website https://joseartgallery.com/ and/ or mobile application JoseArtGallery (hereinafter Website/websites, Services).
We understand you would like to skip these Terms of Use but it is important for us you to understand your rights, know Community Rules by using our services, as well as Jose Art Gallery's rights and obligations.
Please read these Terms attentively to be sure you understand each of points clearly.

2. User’s consent to the Terms of Use
Terms apply also to all individuals who get access to service Jose Art Gallery (hereinafter - "User", "Users", "You").
Using our services (whether or not you are registered) you give your consent to be bound by these Terms in full, without reservation or exception.
If you do not agree to these Terms in whole or in part, we ask you to leave this Website and/or remove the application from your device.

3. Privacy policy
Your privacy is important for Us. Please read our Privacy Policy to be informed how we collect and use your personal data, as well as information on how you can manage your privacy using our services.

4. Changes to the Terms
We reserve the right to make changes of these Terms. If you are registered User, we will notify you about any changes of Terms by sending an email to the address you provided when you registered your account. For all unregistered users information about changes of Terms will be available on the website.
If you do not agree with the changes and additions to the Terms, you should stop using Services. The fact of continued use of the Websites after modification of the Terms is a confirmation of the User's consent to the corresponding version of the Agreement.

5. Access to services
We believe that art should be accessible to people of all ages. At the same time, people under the age of 18 may register on our Website only after we have obtained the consent of their parents or legal representatives.
For security purposes, we may ask you about confirmation of your registered data and supporting documents. If such data is not provided or provided, but does not correspond to the information provided during registration, We have the right to refuse the User in access to the Jose Art Gallery Services.
If you are not registered on Jose Art Gallery Service, you can use just its selected opportunities, such as browse community profiles and view their content.

6.Type of User's profile
When registering on the Website, depending on your status and purposes of using the Service, you can choose one of four types of profile.
Please note that if you would like to change the profile type, you will have to completely delete the old account, go though the procedure of registration again and then choose a new profile type. Or create an additional account with a binding to another E-mail.

7. Account
There are two types of accounts: Basic and Pro.
Basic is a free access to Jose Art Gallery's services that includes basic tools for using the services.
Pro is a type of account which provides access to additional functions of the Service ant let post unlimited quantity of works; watch the profile statistics; add a great number of artists and their works (for curators and galleries). Furthermore, Users with Pro-subscription are displayed in a separate list of the tab "Community", including when searching for users.
The price and the full content of the Pro-subscription package are published on the Website. They can be changed unilaterally by us with prior publication on the website.
The Pro-subscription is made on the subscription model for the calendar period, without reference to the number of days of active use of Jose Art Gallery Services. With this in mind, in the case of a premature disconnection of a paid subscription, no refund is made.

8. User's content
The content you publish must comply with the provisions of these Terms, Community Rules an instructions that are provided in chapter FAQ.
The right to access the published content is granted to all Website Users. Content hosted on the Service may be used by JoseArtGallery at its sole discretion, without the User's additional consent and remuneration. At the same time you save all property rights and are personally responsible for the contents of the posted announcement and the sent massages.
Using of content and any other elements of the Service is possible only within the functionality offered by the Website. An exception to this rule is possible with the prior voluntary permission of the legal owner.

9. Monitoring of User's content
JoseArtGallery does not control the whole content you load, host, send or impart in any other way with the help of the Service. In this regard, the User is responsible.
At the same time, in case of self-discovery/referral of the right holder/competent authorities/other people, we have the right to delete/modify the content hosted by the User which does not comply with our Terms, Community rules and instructions that are provided in chapter FAQ.

10. Account deleting
In case you have identified a wish to delete your account, you can do this in the way that is pointed in chapter FAQ. In this case, all the data of your profile will be eliminated.
In case of violation of the Terms and Community Rules by the User, we can delete his/her account at any time. We also draw your attention if you have not visited the service for 18 month (the account was inactive), we can delete it.

11. Refunds
Refunds are made only if due to technical problems of the Service Pro-subscription is not provided. In this case, the refund for the period in which the service was not provided should be made on the User's application , on the bank card with which the payment was made.
We are not responsible for technical problems caused by the Service in the event of force majeure situations (irresistible force circumstances).

12. Transactions between Users and settlement of claims and disputes
The Jose Art Gallery platform provides for the possibility of direct communication between the user and the seller. And this means that you can negotiate the purchase of an artwork directly. However, when concluding such a transaction, Jose Art Gallery assumes absolutely no responsibility for its consequences.
 
13. Restrict of User's actions
The User is prohibited from violation and circumventing security measures of the Websites; checking the vulnerability of systems and networks, unless it a part of the proven Jose Art Gallery error compensation program; making any changes to the software of the Websites; interfering with the work of JoseArtGallery Accounts or hosts and networks, for example, send viruses, overload servers, send spam; collecting and storing personal information from Jose Art Gallery or Jose Art Gallery Users without their permission; transfer Account's functions for a compensation; using a profile name similar to that of those users to impersonate them; creating publications where description, title, photos are not related and/or illegible; posting any information about services of our competitors; creating publications about selling multiple works at the same time; posting links to resources containing malicious elements or links to pages of other websites.
It is prohibited to post illegal content because of which Jose Art Gallery can be blocked in Google and at the AppStore and GooglePlay. These content includes: illegal, aggressive, erotic or pornographic materials; shocking content; content containing violence, hate speech, serious threats or direct attacks against a person or a group of people; content aimed at inciting national, racial or religious enmity and hatred, at humiliating national honor and dignity or insulting people's feelings due to their beliefs , race, ethnicity, skin color, language; spam; any other prohibited materials under applicable law.
The depiction of naked bodies in painting and sculpture is permitted (subject to the above-mentioned restrictions). The nature of their presentation and the angles of demonstration should not give pornographic subtext.
We have the right to delete publications at the request of rights-holders or competent state authorities. We also reserve the right to delete any advertisements that we believe are not in accordance with the principles of public morality.

14. Limitation of liability
We undertake to make every effort to properly discharge our responsibilities under the Agreement, including the stable operation of the services. However, We are not responsible for any unauthorized access to our Services and/or any information about our Users.
Non-enforcement to ensure compliance or compulsory execution of any provisions of the current Terms cannot be construed as abandoning them.
It is our right at any time stop supporting (functioning) certain versions of the application Jose Art Gallery for mobile devices based on any operating system.
