Return policy

The Return Policy described herein will help you better understand when you may return or exchange the Goods purchased from Jose Art Gallery. This policy specifies the period within which you may return the Goods, the conditions for their return, requirements to their condition upon return and the return procedures. The aim of the Return Policy is to protect customer rights and ensure customer satisfaction.

According to the EU Consumer Rights Directive adopted on October 25, 2011 that contains provisions on the right to return goods and to the Federal Law of the Republic of Austria, the right to return goods is referred to as the “Right of Withdrawal”. We will use the term “Right of Withdrawal” hereinafter in this Policy.

1. Right of Withdrawal

You shall be entitled to withdraw from the sales agreement, i.e. to return goods purchased from Jose Art Gallery within fourteen days without providing any reason. This right shall apply to all types of the Goods except those that have been tailor-made by the Buyer and except the Digital Goods.

The period of the Right of Withdrawal is fourteen days from the date:

а) on which you or a third party authorised by you, other than the carrier, have taken possession of the Goods.

b) on which you or a third party authorised by you, other than the carrier, have taken possession of the last item of the Goods delivered, if you have ordered several Goods under one order, which are delivered separately.

Please note that if you have ordered several Goods to be delivered separately under one order, but these Goods are delivered from different Sellers from different countries or locations, then each item to be delivered separately from different Sellers will be treated as a separate transaction. The return period for each of the Goods begins from the date of receipt of that item of the Goods. This means that if you have received the first item of the Goods, the return period for that item of the Goods begins when you or a third party authorised by you, other than the carrier, takes possession of the Goods, regardless of whether you have already received the other Goods from your order.

To exercise your Right of Withdrawal, you shall provide your full name, address, telephone number, e-mail address and inform us of your decision to withdraw from the sales agreement by means of a clear statement (e.g. a letter sent by post or e-mail). You can use the enclosed sample withdrawal form for this purpose, but this is not compulsory. If you use this option, we will immediately send you an e-mail confirming receipt of such a withdrawal.

In order to meet the deadline for the Right of Withdrawal, you only need to send us a notification of your use of the Right of Withdrawal before the 14-day deadline has expired.

2. Implications of Withdrawal

If you exercise the Right of Withdrawal, we will refund all payments we have received from you, including the cost of delivery (except for additional costs due to the fact that you have chosen a delivery method other than the low-cost standard delivery method offered by us), without undue delay. We will do this at the latest within fourteen days from the date on which we received your notice of withdrawal from this agreement. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no case will we charge you for this refund. We may refuse your refund until the Seller or Jose Art Gallery (whichever was responsible for the shipment of the Goods) either receives the Goods back or you provide proof that you have returned the Goods, whichever occurs first.

You shall also return the Goods received to the Seller or Jose Art Gallery (whichever was responsible for the shipment of the Goods) immediately but no later than 14 days after you have applied for a Right of Withdrawal. The deadline shall be deemed to have been met if you send the Goods back before the 14-day period has expired.

You shall bear the direct costs of returning the Goods. You shall only pay for any loss of value of the Goods if this loss of value is due to the handling of the Goods in a manner that is not required for checking the condition, properties and functioning of the Goods.

3. Exceptions to the Right of Withdrawal

  • Goods manufactured specifically for a particular Buyer to meet their individual requirements and personal needs, i.e. individual orders. For example, they may be Original Artwork, Handmade Items, Prints, Digital Images or images on Souvenirs.
  • Digital Goods.
  • Damaged Goods if you have not notified us within 48 hours of you or a third party authorised by you, other than the carrier, taking possession of the Goods.

4. Additional Note on the Exercise of the Right of Withdrawal

In order to process your request quickly, we recommend that you contact our customer service team. Moreover, upon return of the Goods, we strongly recommend using the original packaging to avoid possible damage. This will allow us to assess the condition of the Goods more accurately and provide you with a quick refund.
