1. General Provisions
Jose Art Gallery is a marketplace where you can offer and sell original artworks, their reproductions, and digital files of their images, souvenir products, and other handmade items (hereinafter collectively referred to as "Product" or "Products") through our Website available at https://joseartgallery.com (the "Website") or mobile application (the "Mobile Application").
To ensure that you and our customers receive maximum satisfaction and professional service from Jose Art Gallery, we ask that you carefully read this Seller Policy.
Jose Art Gallery is a platform connecting buyers and Sellers, but is not a reseller. The buyer and Seller make a purchase or sale directly. Most Products are shipped and delivered to customers by Sellers under their sole responsibility. Some Products are supplied by Jose Art Gallery.
This policy is part of our General Terms of Use. By creating a gallery of Products on our Website, you agree to this Seller Policy, General Terms of Use and other Policies and Rules
Website.
We may change this Merchant Policy by notifying you of such changes by email or by providing a notice in your Account. New Rules will take effect immediately upon publication unless otherwise stated. You agree to be bound by any changes if you continue to use the Website after such changes are posted.
2. What Can You Sell at Jose Art Gallery
Note! Prints, memorabilia and digital files are temporarily unavailable for sale.
2.1. Original artworks and handicrafts
We do our best to ensure that every professional or art lover on the Jose Art Gallery website receives inspiration and is surrounded by an atmosphere of love for creativity, unique artworks, beautiful visual images, and new ideas. Accordingly, the Products that you may offer for sale at Jose Art Gallery must only be original artworks and/or handcrafted Products.
You acknowledge and agree that you are solely responsible for the creation of your gallery of Products and agree to sell Products that (1) are original artworks or handcrafted products or made by you personally or to your design and you are the sole and exclusive owner thereof ; and (2) You have all rights, licenses, consents and permissions to sell such Products (including on behalf of the copyright owner who has authorized You to do so, if applicable); or (3) such Products are original artworks, but are not made or designed by You, however, belong to You by right of ownership and You are not limited by law in the right to resell such Products and do not violate the rights of third parties to intellectual property, you have all rights, licenses, consents and releases that are necessary to provide Jose Art Gallery as contemplated by the Website Policies.
Also, when publishing Products, you undertake:
- Publish your own photo and video content, and not content from other Websites, for example, including, but not limited to, content from photo stocks, photo banks or other libraries.
- Indicate true authorship of the artwork or handicraft.
- Identify the subcontractor or manufacturer, if applicable, which is the person or entity that helps turn your own design into the final product.
Original artworks are unique creations created directly by the artist, without direct copying or reproducing the work of others. Original works include, but are not limited to the following categories:
- Painting is a artwork created using oil, watercolor, acrylic or other paints on canvas, paper or other suitable materials.
- Graphics are artworks created using various drawing techniques, including charcoal, pencil, ink, pastel and other media on paper or other suitable materials.
- Sculpture is three-dimensional artworks created by carving, modeling, casting or assembling using materials such as clay, stone, metal, wood or modern composite materials.
- Digital art is artworks created or shaped using digital technologies, including computer graphics, digital painting and digital sculpture, as well as through graphic editors using artificial intelligence.
- Photography - Images created by capturing light on photographic film or through a digital sensor.
Accordingly, Products containing original artworks are published on our Website in the Artworks section, in the following subsections:
- painting;
- graphic arts;
- sculpture;
- digital art;
- photo.
When publishing original artworks in the “Photography” and “Digital Art” subcategories, you undertake to indicate in the descriptive part of the Product information about its characteristics, including materials and method of production (printing) on a physical medium. If such specifications are not provided when you add a Product to the Website, you must provide this information yourself. In the case of selling these types of Products in physical form, you also undertake to personally carry out their high-quality production (printing), guaranteeing a high level of workmanship. This means that all printing processes must be carried out by you as the Seller to ensure high quality standards and the uniqueness of each product.
You can sell Products from the Photography and Digital Art subcategories in Open Edition and Limited Edition formats. At the same time, Jose Art Gallery reserves the right to unilaterally limit the number of copies for Limited Edition publications.
- Open Edition means that a work, such as a photograph or digital painting, can be printed in an unlimited number of copies. This means that anyone can purchase such a copy, and the production of these editions is not limited by quantity. Open Editions may be available in a variety of sizes, materials and other designs.
- Limited Edition means that the number of copies of a work is strictly limited. This can be either a physical item or a digital file. For example, an edition may be limited to as few as 100 copies, with each copy usually numbered and signed by the author or maker. These editions have increased value due to their limited availability, making them more unique and desirable to collect. In addition, limited editions may include exclusive elements, such as special packaging or certificates of authenticity for physical copies, highlighting their uniqueness and authenticity.
Original artworks constitute the main category of Products on our Website. All other categories of Products, such as prints, merchandise and digital Products, are produced under license from the copyright holder based on images of original artworks.
The minimum price for the Buyer of original artworks offered for sale by the Seller cannot be less than 200 euros.
3. What Cannot be Sold at Jose Art Gallery
You agree that you will not post Products that:
- violates our Intellectual Property Policy;
- contains elements of a pornographic nature;
- humiliates the honor and dignity of a third party, other users of the Website;
- incites interracial, interethnic, religious, sexual and political hatred;
- violates the rights and/or freedoms of third parties;
- violates the laws of the Kingdom of Spain;
- contains links to third-party sites of any nature;
- contains obscene language;
- contains advertising of alcohol and/or tobacco products;
- contains calls for violence;
- contains slander towards a third party;
- presented with a low-quality photograph or description;
- repeats the Product previously published on the Website;
- contains misleading information regarding the origin, quality or characteristics of the Products;
- promotes or supports illegal or ethically questionable activities, including, but not limited to, illegal trade, sale of prohibited substances or Products;
- uses images or descriptions that may be perceived as a threat to public safety or order.
4. Who Can Sell at Jose Art Gallery
4.1. Users of the Website must meet one of the following categories:
- An adult natural person who has the necessary civil legal capacity.
- Entity. If you are acting on behalf of a legal entity, you warrant that you have the authority to represent that legal entity.
Depending on the selected Account type, users have different rights to sell Products:
- Artists may sell original artworks they have created personally, digital Merchandise (digital file licenses), merchandise, and prints (produced by Jose Art Gallery).
- Curators and galleries may sell original artworks on behalf of copyright holders who have authorized them to do so. In order to sell prints and digital Products, artists, curators and galleries must undergo a special credential verification process. Contact support@joseartgallery.com for more information and to begin the verification process.
- Collectors can sell original artworks that are not created or designed by them personally. Such works must be owned by the Seller and the Seller represents that it has all necessary rights, licenses, consents and permissions to publish and sell the Product through the Jose Art Gallery Website and does not infringe the rights of third parties, including intellectual property rights.
Seller's obligations:
If the Seller publishes Products for which intellectual property rights belong to a third party, he undertakes to obtain permission from the copyright holder to represent his interests, including permission to sell such Products.
4.2. Accuracy of data provided
When registering on the Jose Art Gallery Platform, Sellers are required to provide accurate and current personal information. They are also responsible for promptly updating this data in the event of any changes. To maintain trust and security on the platform, Jose Art Gallery or its authorized agents reserve the right to conduct authentication checks on Sellers, including accessing public data or interacting with licensed payment service providers. These measures are taken to protect the platform's reputation and prevent fraud, money laundering, terrorist financing and violation of trade sanctions.
4.3. Power of attorney from the copyright holder
Sometimes there are reasons to suspect that the Seller, acting in the interests of third parties, does not have the necessary rights, licenses, consents and permissions from the copyright holder to sell it, which may lead to a violation of the legitimate interests of the owner of intellectual property.
In such cases, we reserve the right to request from the Seller documents confirming the availability of an appropriate license or power of attorney to use the rights to the Products being sold. Documents must be provided in PDF or JPG formats and must be clearly legible. These documents must be signed or stamped by the copyright holder or manufacturer of the Product. If you are the copyright holder, you must provide proof of ownership.
We recommend providing clear, high-quality scans of documents to ensure your request is processed quickly and efficiently. To verify the power of attorney or license provided, we may contact the copyright holder you specified.
Note: Jose Art Gallery does not proactively monitor or monitor whether the Seller has received permission from the copyright owner to represent the Seller's interests, including, but not limited to, the sale of an original artwork or handicraft. Also, Jose Art Gallery is not responsible for representing the interests of third parties and for the publication or sale of Products by the Seller without sufficient rights to do so.
5. High Standards of Customer Service
5.1. General requirements
By listing Products for sale on Jose Art Gallery, You agree to be responsible for compliance with all applicable laws, regulations and Website policies with respect to the Products You list for sale. Jose Art Gallery is not responsible for the accuracy or content of the description of Your Products or the timeliness of shipment of Products.
By selling on Jose Art Gallery, you agree:
- Provide quality customer service and maintain customer confidence;
- Respond to incoming messages from clients or potential buyers in a timely manner;
- Comply with order dispatch deadlines;
- Immediately notify us if for any reason you are unable to complete your order;
- Resolve disagreements directly with the Buyer;
- Process returns and exchanges in accordance with Jose Art Gallery's return policy;
- Make changes to the status of the Product, including its sale, as well as update its availability by regularly updating the status;
- Comply with the terms of the Licenses concluded between you and the Buyer;
- Adhere to Jose Art Gallery's quality standards and Product descriptions to ensure accuracy of information provided and customer satisfaction.
5.2. Product Publication
To post your Item for sale on Jose Art Gallery, you must log into your Seller Account and list the Item in your gallery.
This process includes:
- Creating a name and description of the Product;
- Adding photographs, images or video reviews of the Product, if applicable;
- Adding keywords to make it easier to find Products on the Website;
- Selecting the category to which the Product belongs;
- Indication of the characteristics of the Product, including technology and materials, size, weight, etc.;
- Indication of the country and address of the location of the Product;
- Selection of images reflecting the appearance of the Product in the interior, if applicable.
- Indication of the price of the Product;
You will be able to make changes to the Product page as long as it is published. Thanks to the complete and detailed filling of the Product page, users can easily find the required Product and obtain all the necessary information about it on the Website.
5.3. Guarantee that the availability of physical Products is regularly checked
You agree to regularly check the availability of the physical Products listed for sale in your gallery on Jose Art Gallery. You are solely responsible for the availability of such Products offered for sale and for which you are responsible to the buyer for shipment. If a Product is sold outside of Jose Art Gallery, or if there is any other reason for recalling or withdrawing a Product from the Website, you must update the status of the Product on the Website within 24 hours. Failure to update the availability of a Product may adversely affect the Product's ranking among others on the Site and may cause it to become unavailable for immediate sale.
5.4. Best price guarantee for the client
Seller agrees not to sell its physical Products outside of Jose Art Gallery at a price lower than the customer price listed on the Jose Art Gallery Website. You warrant and agree that the prices for your Products on the Jose Art Gallery Website are the most competitive in the market.
5.5. Notification of Products availability and preparation for shipment
In the case of the sale of an original artwork in physical form, the Seller undertakes to notify Jose Art Gallery of the availability of the Product and preparation for its shipment within 24 hours after the buyer places and pays for the order. If the Seller does not take such actions, Jose Art Gallery has the right to take the following measures:
a. Cancel the sale of the Product and return the money to the buyer;
b. Apply one or more of the following sanctions to the Seller:
- Block the Account for a certain period of time;
- Delete your account;
- Deduct monies from the Seller's balance as compensation for any damages to the buyer and/or Jose Art Gallery, if applicable.
6. Obligations to Ship the Products

6.1. Delivery method
Jose Art Gallery prefers to use DHL Express as its primary partner for the delivery of physical Products from Seller to buyers. When selling your Product, we will provide you with all the necessary instructions and documents for its shipment, which you can use at your nearest DHL office or when calling a courier to the shipping address.
In some cases, by prior agreement with our specialists, it is possible to use the services of other premium courier services, subject to compliance with standards that guarantee high quality customer service.
If you choose to ship an Item other than through Jose Art Gallery's partner courier service and pay your own shipping costs, Jose Art Gallery will reimburse you for the costs incurred. Such refunds are subject to prior agreement on shipping terms between the Seller and Jose Art Gallery. To clarify terms and arrange a refund, please contact our support team at support@joseartgallery.com.
6.2. Calculation of the cost of delivery services
Jose Art Gallery automatically calculates shipping costs worldwide based on the dimensions of the package and the destination country. To calculate shipping costs and customs duties, we use data from the express carrier.
Prices available to customers on the site include shipping costs, insurance, customs fees and taxes (if applicable) to the country of delivery. For large pieces of art, shipping costs may not be calculated automatically, but rather manually. In such cases, upon customer request, our staff will consult with a specialized carrier, and such works may be displayed on the site with the note "Order".
When adding a Product to your gallery for sale on Jose Art Gallery, you are required to provide accurate information about the weight, dimensions and shipping address of the Product. In the event that actual weight, dimensions and shipping information differ from those previously provided, Jose Art Gallery reserves the right to deduct additional shipping costs from your fee.
Additionally: We do not exclude the possibility of additional customs duties when importing a parcel into the buyer’s country, which is extremely rare. Customs duties are calculated by the customs officer of the recipient country, and if additional payments are assessed, the buyer pays them upon receipt of the parcel.
6.3. Urgency of shipment of the Products
The Seller is obliged to make every effort to send the Product to the Buyer as soon as possible after placing the order.
The Seller has 24 hours to confirm the availability of the Product after the buyer places an order. Confirmation of Product availability and the date of shipment must be made in the "My Orders" section of the Seller's account.
The Seller undertakes to take all possible measures to send the parcel within 3-5 business days from the date of placing the order. The Seller must immediately notify Jose Art Gallery of any delays or obstacles encountered.
If additional time is required to prepare the Product for shipment, the Seller must indicate this in the description of the Product and inform both Jose Art Gallery and the buyer if such information has not been previously provided.
6.4. Product Packaging
The Seller is solely responsible for the packaging of the Product. All packaging costs must be included in the price of the Product. The seller is obliged to provide reliable and correct packaging of the products to ensure their safety during delivery. It is important that the packaging is easy to open and close and is strong enough to allow the buyer to use the same original packaging if the Product is returned.
6.5. Documents for shipment
Jose Art Gallery makes it easy for Sellers to complete the paperwork to ship Products. After the buyer places an order, in the “My Sales” section of your Seller account, you will find a list of required documents. Most of them will be generated automatically by our system and you will only need to download and print them. Some documents will require printing and subsequent manual completion.

6.6. Delivery Responsibility
All physical Products shipped via DHL Express and registered on the Website are subject to insurance. The delivery service is responsible for the delivery of such Products.
Jose Art Gallery is not responsible for the safety of the Product during transportation, including any damage, loss of the Product or original packaging, and does not undertake to compensate for losses or refund money to the Seller if the damage was not caused by the fault of the Website.
In the event of an insured event, Jose Art Gallery will provide maximum assistance in resolving issues with DHL or other courier service to ensure the protection of the interests of both the Seller and the buyer.
Seller is solely responsible for ensuring that the Product is properly packaged and shipped via a delivery service that minimizes the risk of damage.
If the Seller sends the Product via an alternative courier service without prior notice to Jose Art Gallery, it does so at its own risk. In the event of non-delivery of the Product within the billing period, Jose Art Gallery reserves the right to issue a full and immediate refund to the buyer.
6.7. Receipt of the Products by the client
The Seller may track the status of its Product through the automatic tracking system integrated into the Seller's account on the Website. Once the buyer receives the order, the delivery status will be updated. The Buyer is given a 14-day period to return the Product without giving reasons.
6.8. 14 day return period
This section applies to Products that Sellers independently ship and deliver directly to customers.
Issues regarding the return of Products, for the shipment and dispatch of which Jose Art Gallery is responsible, are resolved by our specialists in contact with customers. We will notify the Seller of the results of such review.
Upon actual receipt of the original artwork or handmade item, the buyer has the right to return the Product within 14 days for any reason. We strive to minimize the likelihood of such occurrences, but if such an occurrence occurs, Jose Art Gallery will endeavor to make every effort to persuade the purchaser to retain the Product by offering alternative solutions. All negotiations with buyers will be agreed upon with the Seller.
If the buyer's decision to return the Product within the 14-day period is final, the buyer will receive a full refund once the Product is returned to the Seller. More information about our return policy can be found in our
Return Policy .
Important to note: When the Product is returned by the buyer, the Seller may be required to pay additional customs duties or VAT, depending on the laws of the country in which he resides. The Seller is required to pay these fees according to local customs regulations. If customs duties are charged during the process of returning the Products, the Seller has the right to apply for their reimbursement to the relevant authorities. Seller is solely responsible for all applicable taxes and fees upon return of the Product, and Jose Art Gallery will not provide reimbursement for such costs.
We recommend that you consult your tax advisors regarding these matters. If upon return the Products are detained at customs due to the Seller's refusal to pay customs duties, we will consider such parcel received by the Seller and the buyer will be refunded his funds.
7. Obligations for Dispute Resolution
The Seller undertakes to comply with legal guarantees of the compliance of its Product with the declared qualities and characteristics, as well as to fulfill its obligations in good faith.
In case of any dispute or problem with an order, the buyer has the right to contact the Seller through the messaging tool on the Website. The Seller undertakes to respond to such a request within 48 hours of its receipt. Seller must regularly check notifications in his Jose Art Gallery account and respond to messages from buyers in a timely manner.
If the buyer makes a complaint, the Seller must resolve the problem within three days. If the dispute is not resolved and the buyer exercises the right to return the Product, Jose Art Gallery will refund the buyer the price of the Product, including shipping costs, within 14 days after the Product is received by the Seller in its original condition and packaging.
Jose Art Gallery reserves the right to refund the buyer from the amount payable to the Seller, including his balance reserve.
If the Product is returned due to non-compliance with the declared qualities and characteristics, the Seller bears all costs associated with returning the Product.
8. Pricing, Payments, Compensation
8.1. Pricing
Determining the price of the Product
The Seller has the right to independently set prices for its Products presented on the Jose Art Gallery Website, in accordance with current legislation. The price shown must include all taxes and packaging costs, but should not include shipping costs. Jose Art Gallery calculates the shipping cost when the buyer places an order, based on the delivery address, as well as the dimensions and weight of the Product specified by the Seller. If the actual dimensions or weight of the Product differ from those indicated, additional shipping costs will be borne by the Seller. These expenses will be reimbursed by Jose Art Gallery by deduction from the Seller's fee.
Price negotiations
The primary mechanism for bidding on price on the Jose Art Gallery Website is through the "Make an Offer" function. The buyer can offer his price using this function, after which the Seller will receive a notification in the "Offers and Orders" section of his personal account. The Seller has the option to accept the offer, reject it, or make a counteroffer at a different price. If the Seller accepts the buyer's counteroffer, or the buyer accepts the Seller's counteroffer, the buyer will receive a notification and can proceed to the payment page with the updated price received in response from the Seller. No additional action is required from the Seller.
In addition, the Seller and buyer can discuss the price of the Product directly through the messaging service on the Website. If the parties agree to change the price to a different price from what was originally listed on the Product page, the Seller will be able to update the price in their listing and invite the buyer to complete the purchase directly through the Website.
Protection of interests
To protect the interests of buyers and Jose Art Gallery, if it is discovered that the Seller is trying to redirect the buyer to another online resource to complete the transaction, Jose Art Gallery reserves the right to apply sanctions to the Seller. These sanctions may include temporary blocking of access to the account or permanent deletion of the account.
8.2. Payments and withdrawals
Jose Art Gallery establishes the following procedure for paying remuneration to Sellers:
Reward display
Once a Product is sold, the Seller's fee amount will be displayed in the "My Sales" section of each order number's account.
Transfer to Balance
The amount of compensation, minus the Jose Art Gallery commission, taxes (including VAT), and other applicable fees, will be automatically transferred to the seller's balance in the Bills & Incomes section 14 calendar days after the buyer's actual receipt of the Product. This applies to the sale of original artworks, handmade items, souvenirs, prints, and digital products.
Withdrawal of Funds
After funds have been credited to the account balance in Jose Art Gallery, the seller can request a withdrawal of available funds.
Two withdrawal options are provided:
- To a bank account.
- To an account in the Payoneer payment system.
To do this, you need to confirm the withdrawal request by clicking the "Withdraw Funds" button in the Bills & Incomes section. When making a withdrawal request, the seller must specify their bank account details or the email address registered with the Payoneer account.
After submitting the request, the seller will receive a notification to their email address confirming the request and providing the details for the withdrawal. We strongly recommend verifying these details to avoid mistakenly sending funds to incorrect accounts.
The seller can provide withdrawal details in advance before making sales on the website, after completing profile verification.
Withdrawals are usually processed within 10 business days from the date of the request. Withdrawal times may vary due to reasons beyond the control of Jose Art Gallery and not caused by our fault.
8.3. Compensation for losses and refunds
Withholding rewards
If a Seller's account is suspended or deactivated due to a violation of the site's policies, Jose Art Gallery has the right to retain any fees and/or other compensation that would otherwise be paid to the Seller. These funds may be retained as liquidated damages.
Adjustment of overpayments
In the event of an overpayment of compensation to the Seller, Jose Art Gallery has the right to deduct the amount of such overpayment from the Seller's balance or demand an immediate refund of the overpaid amount.
Cancellation of orders
Jose Art Gallery reserves the right to cancel any order placed on the Website for any reason and at any time before it is shipped to the customer. In case of order cancellation, the buyer will receive a full refund. The Seller will not be entitled to any compensation from the sale. If the Product has already been shipped to the buyer, the Seller must accept it back in accordance with the terms of Jose Art Gallery's returns policy.
9. Payment for Services, Taxes, and Fees
The Seller is required to pay for Jose Art Gallery Services, including applicable fees, and acknowledges Jose Art Gallery's right to collect applicable taxes.
9.1. Financial Compensation
Jose Art Gallery establishes the following commission rates for the sale of original artworks:
40% for "Artist" accounts;
40% for "Curator" accounts, when adding fewer than four artists;
25% for "Curator" accounts, when adding four or more artists;
20% for "Gallery" accounts;
40% for "Collector" accounts.
For the sale of prints and souvenir products, Sellers receive 100% royalties, corresponding to the full amount of their share of the compensation specified when listing the Product for sale.
Jose Art Gallery receives a fixed fee for each individual print format or unit of product, depending on the materials and print bases used.
For the sale of digital Products, Sellers receive a fixed royalty percentage of 60% of the buyer's price, excluding taxes.
9.2. Taxes
An important aspect of any sales transactions is the matter of taxes. All amounts mentioned in the Website Policies do not include taxes such as value-added tax (VAT), similar taxes, or customs duties and tariffs that may be levied by governmental tax authorities in accordance with applicable law.
The Seller is solely responsible for paying all applicable taxes when selling their Products through our Services. Jose Art Gallery does not collect taxes it is not required to collect, but if applicable, Jose Art Gallery will withhold the necessary amounts of value-added tax VAT (which in some jurisdictions is referred to as GST or local sales taxes) from the payments made to you. The withheld amount will be automatically displayed in your account, and Jose Art Gallery will remit this tax to the tax authorities.
For residents of the European Union and the European Economic Area, VAT is charged according to the applicable rate set by the legislation of the country of residence.
If you have any questions regarding tax obligations related to the sale of Products, it is recommended that you consult your tax advisor for additional information.
The Seller agrees to cooperate closely with Jose Art Gallery, ensuring the provision of any necessary documentation or forms required by applicable laws to ensure the effective fulfillment of obligations and the exercise of all rights provided by law, including, but not limited to, the tax field.
9.3. Indirect Taxes
Jose Art Gallery applies indirect taxes, such as VAT (value-added tax), to commissions paid to artists in accordance with EU law. As of July 1, 2021, under the new EU rules, marketplaces are required to account for and remit VAT on cross-border transactions between businesses and consumers if both parties to the transaction are within the European Union. Thus, Jose Art Gallery, registered in Spain and operating as a marketplace, is required to collect VAT on commissions from artists who do not have a VAT number.
For example, if a French artist (not registered as a VAT payer) sells an artwork for 1,000 euros, Jose Art Gallery charges a commission of 40% or 400 euros. In this case, 20% VAT is added to the commission at the French rate, which amounts to 80 euros, so the total amount charged to the artist will be 480 euros.
Thus, artists making significant sales may find it beneficial to register as VAT payers to be able to reclaim the taxes paid. Providing Jose Art Gallery with a verifiable VAT identification number will avoid VAT being charged on platform service commissions.
9.4. Payment Processing and Payout Fees
The Jose Art Gallery Seller agrees to pay a fee for payment transfers using the chosen payment method. This fee is charged by Jose Art Gallery to cover administrative expenses and other costs associated with the payment method chosen by the Seller. The cost of the fee may vary depending on the chosen payout method.
If the Seller withdraws funds from their balance in a currency different from the settlement currency specified in their account, Jose Art Gallery charges a currency conversion fee. This fee rate may differ from the rates effective on the date of the transaction.

10. Discounts
Jose Art Gallery actively conducts various promotional offers aimed at attracting new buyers and maintaining interest among existing collectors in a wide range of art. This opens up opportunities for artists to present themselves to a new audience and increase the likelihood of future sales of their artworks.
You agree that Jose Art Gallery may conduct various promotional offers for any category of Products published on the Website. These promotions may include various types of discounts on Products. You agree to comply with all conditions related to promotional offers, including selling Products at a special price, taking into account the discount on the original cost.
A collector may use a special offer in the form of promo codes when purchasing your artwork on Jose Art Gallery and apply a discount during the purchase. Promo codes usually provide a discount of 10% to 20% on the purchase of original artworks, not exceeding the specified percentage.
For the client, in the case of using a promo code, the discount will be applied to the public price of the artwork listed on the site.
For the artist, when calculating payments for a sold artwork, the discount amount will be deducted from the price of the artwork excluding shipping costs, after which the commission will be calculated according to the standard 60/40 split scheme, where 60% is the artist's share (Seller's reward), and 40% is the gallery's share (gallery commission).
Example:
- Discount calculation for the client: The artist lists a painting for sale for 1,000 euros, where 600 euros is the artist's reward, and 400 euros is the gallery's commission. Shipping costs 300 euros. The public price on the site is listed as 1,300 euros (1,000 for the painting + 300 for shipping). The client applies a promo code for a 10% discount, which is 130 euros off the total cost (1,300 euros). With a 10% discount, the client pays 1,170 euros instead of 1,300 euros (1,300 euros - 130 euros discount).
- Calculation for payments to the artist: The discount is applied to the price of the painting excluding shipping, i.e., 1,000 euros. After applying the discount, the price of the painting is 870 euros (1,000 euros - 130 euros discount). This amount is split between the artist and the gallery in a 60/40 proportion: 60% of 870 euros = 522 euros. This is the artist's reward. 40% of 870 euros = 348 euros. This is the gallery's commission.
Thus, with a 10% discount, the originally expected 600 euros of the artist's income is reduced to 522 euros, and the gallery's commission is reduced from the expected 400 euros to 348 euros.
11. Communication Through Messages
Jose Art Gallery provides a "Messages" feature that allows users to communicate directly on the platform. This is a convenient tool for interaction between buyers and Sellers and with each other. However, using this feature implies compliance with certain rules:
Prohibition of spam and advertising: Sending unsolicited advertisements, spam, donation requests, or any other unwanted information is strictly prohibited.
Prohibition of harassment and abuse: Harassment, abuse, or any other forms of aggressive behavior are not allowed.
Compliance with Community Rules: All users must strictly adhere to the established community rules of Jose Art Gallery.
Prohibition of sharing confidential information: It is prohibited to exchange contact and financial information between users to bypass the official order process through Jose Art Gallery. This includes exchanging phone numbers, email addresses, external URLs, money transfer instructions, and any other confidential information.
We strongly recommend that all users strictly follow these rules to ensure safety and comfort when using the "Messages" feature.
12. Transmission of Seller Information
Jose Art Gallery guarantees the protection of your personal information and strives to ensure its confidentiality. However, you agree that Jose Art Gallery will disclose your personal information and transaction details to relevant government authorities where required by law. In other cases, Jose Art Gallery does not share any personal information with third parties, so you can be assured of the safety of your data.
13. Product Rating
Jose Art Gallery unilaterally assigns a rating to each Product, based on its own experience, user evaluation criteria, and comments.
Products with high ratings are given priority in publication, occupying the top positions in the relevant sections of the Website. Conversely, Products with low ratings are placed at the bottom of the lists. This policy helps maintain the quality and relevance of the offerings on the platform, ensuring users have access to the most valuable and popular Products.
The user acknowledges and confirms their obligation not to dispute the rating assigned to the Product by Jose Art Gallery.
14. Product Not Allowed or Removed from Publication
Jose Art Gallery has the right not to publish a Product or to remove a previously published Product (with or without stating the reasons) if the Product:
- Violates the rights of third parties, including property and intellectual property rights.
- Contains elements of pornography.
- Defames the honor and dignity of third parties or other users.
- Incites racial, national, religious, gender, and political hatred.
- Violates or complies with the laws of the Kingdom of Spain.
- Contains links to third-party sites of any nature;
- Contains obscene language.
- Advertises alcohol and/or tobacco products.
- Calls for violence.
- Contains slander against a third party.
- Contains low-quality photos or photos taken incorrectly - with distortion, capturing other objects, etc.
- Duplicates previously published Products on the Website.
- If a complaint is received from other Users about the Product.
Unfortunately, it is technically impossible to specify all the reasons why a Product may be removed from your gallery. Jose Art Gallery reserves the right to block and/or remove a Product you have published if it considers that such a Product in any way contradicts the Policies of our site.
15. File Requirements
To ensure high-quality images and user safety, Jose Art Gallery establishes the following requirements for uploaded files:
Security: When uploading files with Product images, the Seller confirms and guarantees that they have all the necessary rights to the file and the authority to grant Jose Art Gallery the rights for its commercial use. This includes the need to have appropriate permissions for files containing images of people or private property. If the Seller acts on behalf of third parties, they must have all the necessary documents confirming copyright and related rights, as well as the right to commercially sell the file.
File Formats: Accepted image formats are JPG, PNG, WEBP.
Image Resolution: It is recommended to upload images with a resolution of at least 300 dpi to ensure high quality. The minimum acceptable resolution is 72 dpi. High-quality images improve the perception of the Product and contribute to increased sales. Low-resolution images do not meet platform standards and will not be approved for sale.
Image Size: The minimum size on the shortest side should be 600 pixels.
File Size: The maximum file size should not exceed 100 MB.
Image Quality: The uploaded image must be clear, without distortions and extraneous elements such as watermarks, stickers, frames, and advertising materials.
Jose Art Gallery takes measures to ensure that all images meet high standards of quality and safety. Uploading images that violate copyright is strictly prohibited.
16. Intellectual Property
The Seller agrees not to publish on the Website Products, including their images and descriptions, that infringe on anyone's trademark, patent, copyright, or other similar proprietary rights.
The Seller acknowledges and agrees that neither Jose Art Gallery nor any of its officers, managers, directors, or employees, Partners, agents, or affiliates are responsible for direct or indirect damages resulting from intentional or accidental actions, resulting from the use or inability to use any images or files with images presented on the Website.
Jose Art Gallery has the right to refuse to publish Products or their images on the Website for any reason. Products or their images will be removed if Jose Art Gallery believes that the posted Products will entail legal liability for Jose Art Gallery or any of its officers, managers, directors, or employees or if the Products violate the Terms and Policies of the Website.
The Seller will cooperate in good faith with Jose Art Gallery to timely and amicably resolve any disputes regarding intellectual property rights related to the Seller's Products. Such cooperation, among other things and actions, will include direct communication with claimants, reviewing materials confirming authorship, consultations with Jose Art Gallery representatives or their authorized representatives.
17. Delegation of Authority
17.1. Licenses You Grant Us
By posting Original Artworks or their reproductions (Prints), Souvenir Products, or Handcrafted Items on Jose Art Gallery, you: (1) grant Jose Art Gallery a worldwide, royalty-free, irrevocable, transferable, non-exclusive right and license with the right to sublicense to use, display, edit, modify (if necessary in connection with print production), create derivative works, reproduce, distribute, store, broadcast, publicly perform, and publicly display your original artworks, handcrafted items, or prints in any form, on any media, separately or in combination with other content or materials, in any manner and by any means, methods, or technologies, now known or created in the future, in connection with Jose Art Gallery Services, and you (2) grant visitors of the Website the right and license to view your Products on or through the Website Services. This allows us to promote Jose Art Gallery and the Services in general, using any formats and channels, including any Jose Art Gallery services, partners, or third-party websites or advertising tools.
The Seller, having posted a Digital Product with an image on Jose Art Gallery, thereby grants Jose Art Gallery the right to grant Buyers licenses to such Digital Products of the Seller (hereinafter referred to as the Digital File).
When the Seller posts a Digital File with an image on Jose Art Gallery, Jose Art Gallery receives the following rights: to use, publish, post, reproduce, modify, republish, compress, transmit, create and sell prints or other copies created by other means, to publicly display, exhibit, and reproduce Digital Files, as well as to grant these rights to Buyers of licenses for the Seller's Digital File on an exclusive and non-exclusive basis in accordance with the terms of Jose Art Gallery's license agreements.
Jose Art Gallery, buyers, or third parties receive a license to the Digital File in accordance with these Website Policies.
The Seller, in turn, by accepting the terms of these Policies, grants the right and guarantee of a worldwide exclusive or non-exclusive, lifetime, non-transferable (sub)license to end buyers for the digital file in accordance with the terms of the license agreements on this Website.
The Seller understands and agrees that Jose Art Gallery has the right to distribute and advertise digital files not only through the Website and Mobile Application but also through other methods, counterparties, third parties (hereinafter collectively referred to as the "Third Party") at its own discretion, without coordinating with the Seller.
Jose Art Gallery has the right to provide or transfer licenses, certain rights or restrictions, and obligations on the Digital File to Third Parties.
Jose Art Gallery has the unconditional right to provide Third Parties with access to the Digital File you have published on the Website, through any software interfaces and by any means, at the sole discretion of Jose Art Gallery, taking into account the terms of the license agreements.
The Seller understands and agrees that Jose Art Gallery, without paying any compensation, has the right to use the Digital File in its own activities or through the activities of Third Parties, within the framework of issuing licenses for the Digital File, in Jose Art Gallery's advertising activities, including advertising the Website or Mobile Application.
Regardless of how the Digital File is obtained by the Buyer or Third Party, the reward for the sale of the Digital File is paid to the Seller in the same amount as when purchasing the Digital File on the Website.
For any images you choose to license through one of our licenses, Jose Art Gallery will have the right, but not the obligation, to license your images to Buyers or Third Parties.
You must read and familiarize yourself with the terms of the licenses on our Website. Carefully read and familiarize yourself with the terms of the licenses governing the Buyer's use of Digital Files and the restriction on the use of Digital Files. Any actions by the Seller on the Website indicate that the license terms are fully understood.
Licenses issued by the Seller to Jose Art Gallery, or licenses issued by Jose Art Gallery for the use of any Digital File that is withdrawn by the Seller from the Website, will remain in full force after such withdrawal.
The Seller understands and confirms that the reward or compensation for granting a license under these Policies or granting other licensing rights under these Policies is only in the form of the reward paid to the Seller upon the sale of the Digital File and/or Original Artwork and/or Print and/or Souvenir Product.
17.2. Ownership of Images
Copyrights to images posted on the Website remain with the owner of such copyrights.
Nothing in these Rules shall be construed as indicating the transfer of any copyrights to Jose Art Gallery.
18. Protection of Personal Data
18.1. Seller Responsibility
You may have access to some personal data of the buyer in connection with fulfilling your obligations as a Seller. For example, you may process the buyer's personal information, such as their name, shipping address, contact phone number, and email. According to EU legislation, in such cases, you become a data controller for other users. This means that you are responsible for processing and protecting their personal information in accordance with GDPR requirements.
You agree to use this data only for the purpose of fulfilling your obligations to the buyer, for example, for processing and delivering the order.
You may not transfer the buyer's personal data to third parties without the buyer's consent.
You must ensure proper protection and processing of the buyer's personal data in accordance with the applicable data protection laws.
You may not use the buyer's personal data to send advertising or marketing messages without the buyer's consent.
You are responsible for any unauthorized processing or use of the buyer's personal data, carried out by you or third parties acting on your behalf.
You undertake to respect the confidentiality of visitors and buyers of the Website whose information you have received.
You must strictly comply with all legal requirements and standards in the field of data protection to prevent unauthorized access, use, or distribution of users' personal information.

18.2. For Photographers

When obtaining such permission, you must ensure that the data subjects understand the purposes of using their photographs on the Website and agree to how their images will be used, for example, in which contexts.
Additionally, you must ensure that the individuals in the photographs are of legal age or have the necessary permission from their parents or legal guardians to process and use their personal data.
Please note. When obtaining such written permission, you must comply with data processing laws and regulations, as well as copyright and other legal requirements when publishing your photographs on the Website.
19. Cessation of Illegal Activities
If we detect violations of the Terms and Policies of the Website on your part, we have the right to temporarily block or completely remove your content, as well as suspend or deactivate your Account and restrict access to the Services.
In case of Account deletion, Jose Art Gallery will withdraw the available funds from your Balance to the payment account specified by you for withdrawals.
20. Account Deletion
The Seller may permanently delete their account, including all their data, Products, and User Content, at any time from the "Account Settings" section in their Account.
21. Acceptance of Policy and Responsibility
After carefully reviewing this Policy, you confirm that you have received all necessary clarifications and details, allowing you to use the Services provided by our Website.
You also agree that our Services are suitable for you and that you give free and informed consent to accept the Terms and Policies of the Website, including this Seller Policy.
If necessary, you undertake to provide Jose Art Gallery with all necessary information and assistance to provide Services to the users of the Website. In addition, you undertake to promptly inform us of any circumstances that may affect the implementation of Jose Art Gallery's Policies as soon as you become aware of them.
We guarantee that the Services we provide meet high standards of quality and safety. However, we cannot guarantee that the Services will be available without interruptions or errors. We will strive to correct any faults that may arise in the operation of the Services as quickly as possible.
When using our Services, you undertake to comply with all applicable laws and regulations and not to violate the rights of other users of the Website or third parties. We reserve the right to take measures to restrict access to the Services or close the Account if a violation of our Rules and Policies is detected.
You agree that Jose Art Gallery is not responsible for the relationships between galleries/curators and the artists they represent on the Website. This includes any issues related to the payment of compensations to artists. Jose Art Gallery acts as a platform for the publication and sale of artworks but does not participate in managing contractual relationships between site users.
Jose Art Gallery does not guarantee the fulfillment of obligations by the Buyer and the Seller of the Digital File as provided in the terms of the License. The platform has no obligation to compensate any losses to the Seller and/or Buyer of the Digital File resulting from its sale, nor is it obliged to monitor the lawful use of the Digital File image by the Buyer, as provided in the License Agreement.
Jose Art Gallery is not responsible for the relationships or consequences that may arise between buyers and Sellers as a result of purchases made through the Website.
You assume full responsibility for any possible consequences of using the Website, as well as for any damage or loss that may be caused to other parties due to your actions.
